Agreement to our legal terms
These Terms & Conditions (“Terms”) are a contract between you and 7 Jewels LLC (referred to as “7 Jewels,” “Company,” “we,” “us,” or “our”), a company registered in the Commonwealth of Pennsylvania, United States. The terms govern your access to and use of the website at https://7jewels.store/
(the “Site”), the mobile application (the “App”), and any other products, features, or services provided by 7 Jewels that reference these Terms (collectively, the “Services”).

By accessing or using the Services you agree to be bound by these Terms. If you do not agree with all of these Terms, you must stop using the Services immediately.

We may update these Terms from time to time. If we make material changes we will post the updated Terms on the Site and/or send notice to the primary contact email on your account. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

1. Eligibility; Account Registration

The Services are intended for users who are at least 18 years old. If you are under 18 you may not use or register for the Services.
You agree to provide accurate, current, and complete information when creating an account and to maintain and promptly update your information. You are responsible for any activity that occurs under your account and must keep your password confidential.

2. Our Services; Geographic Scope

The Services are offered from the United States. By using the Services you represent that use of the Services from your location is lawful. If you access the Services from outside the U.S., you are responsible for compliance with local law.
7 Jewels currently operates in the United States for vendors and customers. In the future, if we expand operations outside the U.S., additional terms, fees, or rules may apply and will be posted on the Site.

3. Intellectual Property

All content provided by 7 Jewels on the Services (text, graphics, images, logos, interface, designs, software, and other material) is owned or licensed by 7 Jewels (“Company Content”). Company Content is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable right to access and view Company Content for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, create derivative works, publicly display, or otherwise exploit Company Content without our prior written consent.

4. User Submissions; Feedback

“Contributions” means any text, images, reviews, ratings, comments, ideas, or other material you post, submit, or transmit to the Services. When you submit Contributions you warrant you have all rights necessary to grant the license below and you will not submit anything that violates these Terms or applicable law.
By posting Contributions you grant 7 Jewels a perpetual, royalty-free, worldwide, non-exclusive, transferable, sublicensable license to use, reproduce, distribute, modify, adapt, publish, translate, publicly perform and display such Contributions for any purpose in connection with the Services and 7 Jewels’ business. (If you prefer, consult counsel about narrower assignment vs. license language.)
To the extent permitted by law, you waive any moral rights in your Contributions that cannot otherwise be licensed.
We have no obligation to host, display, or act on Contributions, and may remove Contributions at our discretion.

5. Products; Listings; Accuracy

Vendors and/or sellers (third parties) list products on the Services. 7 Jewels does not manufacture those products. We do our best to present accurate product information, but we do not guarantee product descriptions, availability, pricing, or colors are error-free.
All sales are subject to availability and final acceptance by the seller. 7 Jewels reserves the right to refuse or cancel any order.

6. Purchases and Payment

Acceptable payment methods are Visa, Mastercard, American Express, Discover, PayPal, and Apple Pay (and any other payment methods we make available from time to time). All prices and payments are in U.S. dollars unless otherwise stated.
You authorize us (or our payment processor) to charge your selected payment method at the time of purchase. We may use third-party payment processors; their fees and terms may apply.
We reserve the right to correct pricing, typographical, or other errors and to cancel orders that were placed based on such errors.

7. Fees, Commissions & Vendor Payouts (summary)

Vendor fees, commission rates, payment processing fees, and payout timing are governed by separate Vendor Agreements and payout schedules. The general fee structure posted publicly on the Site applies unless superseded by a signed Vendor Agreement.
If you are a vendor, review your Vendor Agreement for details about transaction fees, payment processing fees, Shippo usage, shipping deductions, reserves, chargebacks, and payout timing.

8. Shipping, Returns, and Refunds

Vendors and/or sellers are responsible for shipping unless otherwise stated. Vendors may use 7 Jewels’ integrated Shippo service or ship independently; tracking information must be provided for all orders.
The Site’s Returns Policy governs eligibility, timing, and method of refunds and returns; customers should consult the Returns Policy on the Site before purchasing.
Refunds, returns, or disputes involving sellers will be handled pursuant to the Site’s policies; 7 Jewels may, in its discretion, mediate or resolve disputes.

9. Prohibited Conduct

When using the Services you will not, and will not encourage or permit others to:
Violate applicable law or the rights of others.
Post illegal, infringing, defamatory, harassing, abusive, obscene, or otherwise objectionable content.
Circumvent or interfere with our security, site functionality, or content protections, or attempt to reverse engineer software.
Use bots, scrapers, spiders, automated scripts, or other tools to access content or services except as expressly permitted.
Impersonate another person or misrepresent your affiliation.
Use the Services to operate a competitive or revenue-generating service without our written permission.

Violation may result in account suspension and legal action.

10. Mobile App License

If you download or use the 7 Jewels App, you are granted a limited, non-exclusive, non-transferable license to use the App as permitted in these Terms and in accordance with the relevant app store terms. You must comply with all applicable third-party app store rules (e.g., Apple App Store, Google Play).

11. Privacy; Data Transfers; Cookies

Our Privacy Policy (posted on the Site) governs collection, use, and disclosure of personal information. By using the Services you consent to the Privacy Policy and to the transfer, storage, and processing of information in the United States.
If you access the Services from outside the United States, you consent to transfer of your data to the United States for processing.

12. California Residents — Privacy Rights

If you are a California resident, you may have certain rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), LLCluding the right to access, delete, or correct certain personal information and to opt out of the sale or sharing of your personal information. If we “sell” or “share” personal information, California law requires a clear opt-out mechanism (e.g., a “Do Not Sell or Share My Personal Information” link).

13. Service Availability; Modifications

We may modify, suspend or discontinue the Services (or any part) at any time, with or without notice. We are not liable for any modification, suspension, or discontinuance of the Services.

14. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, 7 JEWELS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, LLCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL 7 JEWELS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, LLCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES (LLCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE AGGREGATE LIABILITY OF 7 JEWELS FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO 7 JEWELS IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER. (Adjust cap as you and your counsel deem appropriate.)

16. Indemnification

You agree to indemnify, defend and hold harmless 7 Jewels and its affiliates, and their respective officers, directors, employees and agents, from and against any claims, liabilities, damages, losses, and expenses (LLCluding reasonable attorneys’ fees) arising from your breach of these Terms, your negligence or willful misconduct, or your violation of any rights of a third party.

17. Data Backups; User Data

While we maintain routine backups, you are responsible for any data you transmit or store, and we are not liable for loss, corruption, or improper use of such data.

18. Electronic Communications and Signatures

By using the Services you consent to receiving electronic communications and agree that any agreements, notices, disclosures, or other communications delivered electronically satisfy any legal requirement that such communications be in writing. Electronic signatures have the same effect as handwritten signatures.

19. SMS/Text Messaging

If you opt in to receive SMS messages, message and data rates from your carrier may apply. You may opt out at any time by replying “STOP” to any message.

20. California Users and Consumers

In addition to the privacy rights above (Section 12), California residents have separate consumer complaint channels and enforcement authorities. 21. Governing Law; Venue; Limitations Period

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to choice of law prLLCiples. Any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania. (Confirm county venue with counsel.)

Unless otherwise required by applicable law, any claim you bring against us must be filed within the applicable statute of limitations. For most contract claims in Pennsylvania the limitations period is four (4) years. You should consult counsel about the applicable limitations period for your claim.

22. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy and any additional terms posted on the Site, constitute the entire agreement between you and 7 Jewels regarding the Services.
Assignment: 7 Jewels may assign these Terms in whole or in part. You may not assign these Terms without our prior written consent.
Severability: If any provision is found unenforceable, the remainder of the Terms will remain in effect.
No Waiver: Our failure to enforce any right shall not constitute a waiver of that right.

23. Changes to the Services or Terms

We may revise these Terms at any time. If we make material changes we will notify you by posting a notice on the Site or by emailing the address associated with your account. Your continued use after changes are posted means you accept them.
